Welcome to Undaunted Pickleball . These Terms and Conditions govern your use of this website and participation in my pickleball coaching services.

By accessing my website or participating in my services, you agree to these Terms and Conditions. If you do not agree, please do not use the website or services.

1. Services

Undaunted Pickleball provides pickleball coaching services, including private lessons, group lessons, clinics, camps, and related instructional activities. Services are offered in person and are subject to availability.

2. Eligibility & Minors

Participants must be 12 years of age or older.

Participants under the age of 18 must have parental or legal guardian consent prior to participation. By allowing a minor to participate, the parent or guardian agrees to these Terms on behalf of the minor.

3. Assumption of Risk

Pickleball is a physical sport that involves inherent risks, including but not limited to slips, falls, collisions, overexertion, and other injuries.

By participating in my Services, you voluntarily assume all risks associated with pickleball activities, whether known or unknown, and acknowledge that participation is at your own risk.

4. Waiver and Release of Liability

To the fullest extent permitted by the laws of Manitoba, you agree to release, waive, and hold harmless Undaunted Pickleball, its coaches, instructors, employees, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from participation in my Services, including claims based on negligence.

For minors, this release is given by the parent or legal guardian on the minor’s behalf.

5. Health & Fitness Disclaimer

You represent that you are physically and medically fit to participate in pickleball activities. You are responsible for consulting a physician prior to participation if you have any medical conditions or concerns.

I do not provide medical advice.

6. Scheduling, Payments & Cancellations

Scheduling is arranged directly with the coach.
Payment terms will be communicated at the time of booking.
Cancellation or rescheduling policies will be communicated prior to the session.
Missed sessions without 24 hours notice could result in your deposit being forfeit.
We reserve the right to cancel or reschedule sessions due to weather, safety concerns, illness, or unforeseen circumstances.

7. No Guarantee of Results

I make no guarantees regarding skill improvement, competitive success, rankings, or performance outcomes. Results vary based on individual effort, consistency, physical condition, and other factors.

8. Code of Conduct

Participants are expected to behave respectfully toward coaches, staff, and other participants.

I reserve the right to refuse or terminate Services to anyone engaging in unsafe, disruptive, or inappropriate behavior, without refund.

9. Photography & Video

Photos or videos may be taken during lessons or events for promotional or educational purposes. By participating, you consent to the use of such media unless you notify me in writing prior to participation.

For minors, consent is provided by the parent or legal guardian.

10. Intellectual Property

All website content, training materials, drills, videos, logos, and instructional methods are the intellectual property of Undaunted Pickleball and may not be copied, reproduced, or distributed without prior written permission.

11. Website Use

You agree not to use this website for unlawful purposes or to interfere with its operation. I make no guarantees regarding website availability or accuracy of content.

12. Limitation of Liability

To the maximum extent permitted by law, Undaunted Pickleball shall not be liable for any indirect, incidental, or consequential damages arising from participation in my Services or use of my website.

13. Indemnification

You agree to indemnify and hold harmless Undaunted Pickleball from any claims, damages, losses, or expenses arising from your participation in my Services or breach of these Terms.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Manitoba and the laws of Canada applicable therein.

15. Changes to Terms

I may update these Terms at any time. Continued participation in Services or use of the website constitutes acceptance of any revised Terms.
